TERMS AND CONDITIONS

SIMON J PRICE T/A PTB-BC CONSULTANCY

1. INTRODUCTION
1.1 These Terms and Conditions (“Terms”) govern the relationship between Simon J Price T/A PTB-BC Consultancy (“the Consultancy”), its clients, customers, and vendors.
1.2 By engaging the Consultancy’s services, the client acknowledges that they have read, understood, and agreed to these Terms in full.
1.3 These Terms shall apply to all jurisdictions, including but not limited to Australia, Cambodia, China, Thailand, the United Kingdom, the United States of America, and Vietnam.
1.4 The governing law for these Terms shall be the laws of England & Wales.

2. SCOPE OF SERVICES
2.1 The Consultancy provides business, immigration, and related advisory services.
2.2 The Consultancy does not guarantee the outcome of any application, visa, or process undertaken on behalf of the client.
2.3 The Consultancy does not act as a legal representative or provide legal advice unless explicitly stated in writing.

3. CLIENT RESPONSIBILITIES
3.1 The client is solely responsible for verifying the accuracy and completeness of all information and documents submitted to or received from the Consultancy.
3.2 The Consultancy shall not be held responsible for any errors, omissions, or delays resulting from inaccurate, incomplete, or missing information provided by the client.
3.3 The client must provide all required documentation within the requested timeframe.

4. NO REFUND POLICY
4.1 All fees paid to the Consultancy are strictly non-refundable, regardless of the outcome of any application, process, or service.
4.2 The no-refund policy applies in all jurisdictions, including Australia, Cambodia, China, Thailand, the United Kingdom, the United States of America, and Vietnam.
4.3 The client acknowledges that payment for services is for time, effort, and expertise rendered, and not for the guarantee of any particular outcome.

5. LIABILITY DISCLAIMER
5.1 The Consultancy shall not be held liable for any loss, damage, cost, or expense incurred by the client due to reliance on any service, information, or documentation provided by the Consultancy.
5.2 The Consultancy does not accept responsibility for any consequences arising from third-party actions, including but not limited to government agencies, embassies, consulates, or immigration authorities.
5.3 The client agrees to indemnify and hold harmless the Consultancy from any claims, legal actions, damages, or losses arising out of or in connection with the services provided.

6. LEGAL FEES AND DISPUTE RESOLUTION
6.1 The client agrees to pay all legal fees incurred by the Consultancy in any jurisdiction for any disputes, legal proceedings, court filings, tribunals, or regulatory matters.
6.2 The client agrees to pay the legal representatives acting for the Consultancy in advance of any legal disputes or proceedings.
6.3 Any disputes arising from these Terms shall be resolved through arbitration in London, England, in accordance with the rules of the London Court of International Arbitration (LCIA).

7. CONFIDENTIALITY
7.1 The Consultancy will handle all client information with confidentiality and will not disclose it to third parties except as required by law or as necessary for service provision.
7.2 The Consultancy is not liable for any unauthorized access to client information resulting from cyberattacks, hacking, or other security breaches beyond its reasonable control.

8. TERMINATION OF SERVICES
8.1 The Consultancy reserves the right to terminate services at its sole discretion if the client engages in fraudulent, misleading, or illegal activities.
8.2 The Consultancy may terminate services if the client fails to provide requested information or fails to make payments as agreed.
8.3 Termination of services does not entitle the client to a refund under any circumstances.

9. FORCE MAJEURE
9.1 The Consultancy shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, war, pandemics, or technical failures.

10. AMENDMENTS
10.1 The Consultancy reserves the right to amend these Terms at any time without prior notice.
10.2 The latest version of these Terms shall be available on the Consultancy’s website and shall take immediate effect upon publication.

11. SEVERABILITY
11.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12. ENTIRE AGREEMENT
12.1 These Terms constitute the entire agreement between the Consultancy and the client and supersede all prior agreements, representations, or understandings, whether written or oral.

By engaging with Simon J Price T/A PTB-BC Consultancy, the client confirms acceptance of these Terms and agrees to abide by all stipulations herein.
